ED wonder if you can help. I have recently been issued a parking ticket. But I was never given a parking ticket on my window screen at the time. This ticket arrive in the post yesterday, and claims that the incident took place on the 09/11/15. Which is 27 days ago, looking on he net I believe that a company only has 15 days to send a letter in the post (Schedule 4 of the POFA Act 2012)

The letter also has the incorrect spelling of the location where the car was parked.

This car park before used to allow free parking for up to 1 hour, but now has a small sgin saying permit holders only. There are a privet company, and request that I pay them £60 or after 14 days will be £100.

Can you recommend how I can appeal this fine, given no information is given on the letter sent how I should do this.

Thanks.

{Ed002's Note - I don't know if there is a limit on the time for the ticket to be sent but suspect the 14 days you mention relates too a Police issued NIP for speeding (I have had a number of these). (a) If you think the ticket unfair because you did not park illegally, then gather what data you can to prove that your vehicle was not in the car park at the time. Submit this to whomever issued the ticket and tell them that you wish to deal with the matter in Court. (b) If you admit your offence but you wish to appeal on a technicality of (i) the notice arriving late, or (ii) the signage not being clear then give it a shot but understand the consequences of delaying payment over 21 days - the fine will increase. (c) If, as it appears, you committed the offence and are simply looking for a way out of paying, then you could try ignoring the matter and hope that it simply goes away, you could lie to them saying your vehicle wasn't there and ask them to present their evidence in court, you could come up with some seemingly plausible excuse that you had a ticket from the machine and discarded it after you left that day - not knowing of the proposed offence as there was nothing on your windshield, or you could pay it and take better care in the future.}

Thanks Ed

Just that I have never revived a parking fine in the post before. The only times in the past I got one it was attached to the window screen.
{Ed002's Note - I would assume it is an unmanned car park with CCTV or whatever.}

I had this happen to me about 2 years ago, I parked in a private resident car park as my mother in law lived their, she said there would be no problem. I received a parking fine a week later from a private firm asking for about the same amount as you. in normal circumstances I would of just paid it if I had been in the wrong but dug my heels in over this one as I was not going to be charged for visiting family. firstly go on to youtube and look up private car park fines, it will give you loads of knowledge. secondly these private car park firms have no legal rights to charge you which I found hard to believe when I first had my fine, they sent me threatening letter after letter but I was told to just completely ignore it all and they would go away, which in the end they did, do not cave into them, they will threaten you with court action but would never proceed with it as the costs are not worth their time, they just live on the hope people will pay the fine which most people without knowledge will do. hope this helps.

If it's from a private firm then simply ignore it, they have no way of enforcing it . I have had plenty and simply don't pay. If it's from the council parking enforcement then address the matter as they take it all the way and the bailiffs they get are from the high court and they can take possetion of goods and gain entry into your house. For council tickets they also operate in stopping cars that owe money and take control of your car (provided that you own the car) . Private firms can also get debt collection agencies to try similar approach but they can't get the power to enter your house provided you don't let them in or leave a door open. These also try and worry you to paying the fine threaten you with all sorts ccj and the like. But in my experience of about 4 private tickets nothing has come of it (first one about 8 years ago)

All of this is my personal experience and I ain't quoting 100% fact here. Maybe some other posters have felt the consequences of acting similar to private firms.
